Terms of NFT Sale and Use

Greetings, fellow hunters! We are enthralled to have you join us on this daring expedition. Introducing TR3ASURE, an NFT project that sets forth on extraordinary quests to unlock valuable prizes for the worthiest of Treasure Hunters. Get ready for the mysterious journeys that await!

Before setting off, you should be aware that the risk of loss in purchasing or holding non-fungible tokens can be substantial. We do not act as your broker-dealer, intermediary, agent, or any kind of advisor, including a commodity trading advisor. You should therefore carefully consider whether purchasing or holding non-fungible tokens are suitable for you in light of your financial circumstances. In addition to these Terms, please review our Privacy Policy which also governs your use of the website, for information on how we collect, use and share your information.

  • Acceptance. Definitions

    TLDR: Upon connecting your blockchain wallet, purchasing a TR3ASURE NFT or generally accessing the Website you agree with these Terms, and by purchasing a TR3ASURE NFT at a secondary market several main provisions of these Terms would be applicable.

    • These Terms are a contract between you and TR3ASURE Ltd, a limited company incorporated in the British Virgin Islands. References in these Terms to “TR3ASURE Ltd.”, “we”, “our” or “us”, are to TR3ASURE Ltd. and references to “you”, “your”, “customer” or “user” are to the person with whom TR3ASURE Ltd. enters into these Terms.
    • These Terms apply to your use and access to the Website (as defined below), purchase of TR3ASURE NFTs (as defined below), either from us or at a secondary market and related owning of TR3ASURE NFTs and underlying Complete Artwork (as defined below). Upon accessing the Website, connecting a blockchain wallet to the Website or purchasing a TR3ASURE NFT you agree to be legally bound by and to comply with these Terms, our Privacy Policy and all additional terms, policies, and agreements incorporated herein by reference and amended from time to time at our sole discretion. Any breach of these terms may result in the suspension of your access and use of the Website, at our discretion, without notice to you.
    • When you purchase a TR3ASURE NFT at a secondary market you agree to be legally bound by the following sections of these Terms: sections 4, 5, 6, 7, 9(d), 12, 13, 16.

    • We use the following definitions in these Terms:

      • “Artwork” means digital creations, artworks, designs, graphics work or set of graphic and text components developed and designed by TR3ASURE Ltd, its affiliates and/or contractors;
      • “Complete Artwork” means the specific randomly generated combination of Artwork;
      • “TR3ASURE NFT” means an NFT associated with Complete Artwork;
      • “NFT” means a non-fungible token, which is a special type of crypto assets on blockchain networks with unique identification codes and metadata that distinguish them from each other.

  • Website. TR3ASURE NFTs

    TLDR: We operate the website www.tr3asure.xyz that provides the functionality of random generation of Complete Artworks, issuing (minting) TR3ASURE NFTs associated with such randomly generated Complete Artworks and of selling TR3ASURE NFTs to users.

    • We operate the website www.tr3asure.xyz that provides the functionality of random generation of Complete Artworks, issuing (minting) TR3ASURE NFTs associated with such randomly generated Complete Artworks and of selling TR3ASURE NFTs to users (“Website”). The Website is offered on a self-service basis in accordance with the terms and conditions of these Terms.
    • When you instruct the Website and the related smart contract to issue (mint) a TR3ASURE NFT, a randomly generated Complete Artwork will be automatically associated with such NFT to form a complete TR3ASURE NFT. You hereby acknowledge and agree that generated Complete Artworks are provided “as is” and “as generated” and you will not be provided with the possibility to select any definite Complete Artwork, or to select or make any preference on any of its graphic components, traits, colors, backgrounds, characters or any other components.

  • TR3ASURE Ownership

    TLDR: The team at TR3ASURE Ltd holds the ownership of the name and intellectual property of the TR3ASURE NFT Project, including but not limited to, images, names, logos, 3D layer files, trademarks, the Website, the ability to mint 3D or voxel versions of TR3ASURE, the user interface's appearance, the smart contract code, and any other rights not granted by any licenses.

    • TR3ASURE Ltd is the rightful owner of the name and intellectual property of the TR3ASURE NFT Project. All ownership rights not specifically granted to the users and owners of TR3ASURE NFTs are retained by TR3ASURE Ltd and are the sole property of TR3ASURE Ltd. This includes, but is not limited to, intellectual property rights for Artworks, names, logos, 3D layer files, trademarks, the Website, related smart contracts, branding, marketing material, the ability to mint 3D or voxel versions of TR3ASURE, related smart contracts, including any enhancements, derivatives and improvements thereof, and any other rights not granted through any licensing or assignment agreements. We hereby grant you a limited, revocable, non-exclusive, non-transferable license, subject to the terms and conditions of these Terms, to access and use the Website, its content and related smart contracts solely for purposes approved by us from time to time.
    • Artworks, including the individual layers and elements of Complete Artworks, are proprietary and owned by TR3ASURE Ltd. Therefore, using any individually crafted layers and elements of a Complete Artwork in other projects, or creating derivatives based on our project, is strictly prohibited. In no event shall these Terms assign, license, or otherwise transfer any of our rights on any Artworks or their components to you. As an owner of Artworks, we shall have the full scope of rights, title and interest in or to Artworks, including, but not limited to, to reproduce, adapt, modify, use, perform, display, publish, distribute, sell and duplicate Artworks, in whole, in any components or combinations of Artworks, for any purpose whatsoever, including commercial, by any media and means whether now known or hereafter devised. We shall have the right to revise, edit, manipulate, add to, create and exploit derivative works thereof, use or not use Artworks, their components and combinations and to distribute and exploit Artworks, their components and combinations in any manner and in any medium we may choose.

    • You shall not:

      • make copies of or further distribute the Website or related smart contracts, including copying onto any other medium;
      • distribute, rent, sublicense, lease, resell, or assign the Website or related smart contracts;
      • alter, modify or adapt the Website or related smart contracts, including but not limited to, translating, decompiling, disassembling, reverse engineering, or creating derivative works;
      • resell, rent or otherwise provide access to the Website or related smart contracts to any third party;
      • take any action in an attempt to obtain any other user's data, cause malfunction, crash, tamper with or otherwise impair the Website or related smart contracts and our related services; or
      • use or access the Website or related smart contracts on platforms modified to circumvent the protections offered by the operating system.

  • Your Ownership Rights

    TLDR: By purchasing a TR3ASURE NFT through our smart contract, you own the NFT itself and have a worldwide, exclusive license to use, copy, and display the underlying digital art (Complete Artwork) for personal or commercial use, however subject to certain limitations (you will not be able to sell digital art apart of a TR3ASURE NFT, mint additional NFTs to the same piece of digital art). Your use should not be in connection with any illegal, fraudulent, defamatory or infringing material and you will be responsible to defend and indemnify TR3ASURE Ltd against any claims, damages, proceedings, loss or costs arising from such use.

    • Purchasing and collecting digital art and NFTs is different from purchasing physical items or physical artworks. Once you connect your blockchain wallet and mint a TR3ASURE NFT, or purchase a TR3ASURE NFT at a secondary market, first of all, you purchase an NFT and get the full scope of rights in this NFT, however, you get an exclusive license (as specified below) in an underlying Complete Artwork. Your exclusive license in the Complete Artwork will be subject to your continued ownership of the corresponding TR3ASURE NFT.

    • Subject to your continued ownership of the TR3ASURE NFT and compliance with these Terms and applicable laws, we grant you, for the legal duration of the intellectual property rights and subject to your ownership and control over the TR3ASURE NFT, a worldwide, exclusive and transferable (solely in relation to the sale of the TR3ASURE NFT) license:

      • to reproduce, use, perform, display, prepare derivative works of, and to this end, subject to our moral rights and where technically required, edit, adapt and modify in a non-substantial way the Complete Artwork, in any manner and in any medium you may choose, for any purpose whatsoever, including commercial use;
      • to reproduce, use, perform, display and exploit the Complete Artwork within decentralised virtual environments, metaverses, virtual worlds, virtual galleries, virtual libraries, virtual museums, or other navigable and perceivable virtual environments, in any manner you may choose, and for any purpose whatsoever, including commercial use; and
      • to use, copy, and display the Complete Artwork for the purpose of commercializing your own merchandise.
    • However, due to the specific nature of NFTs as digital assets and the nature of digital art associated with NFTs, we will not grant you the right to sell, license and/or sublicense the Complete Artwork apart of a TR3ASURE NFT. Also, you will not have the right and thus must not mint, tokenize, or create additional cryptographic tokens or blockchain assets representing the same Complete Artwork.

    • In addition, you may not, nor permit any third party, to do or attempt to do any of the foregoing:

      • to modify, distort, mutilate, or perform any other modification to the Complete Artwork which would be prejudicial to our honor or reputation;
      • to use the Complete Artwork in connection with any illegal, fraudulent, defamatory, offensive or infringing materials or for any illegal, fraudulent or defamatory purpose;
      • to use the Complete Artwork in connection with texts, images, videos, or other forms of media that depict hatred, intolerance, violence, cruelty, or anything else that could reasonably be found to constitute hate speech or otherwise infringe upon the rights of others, any applicable law or regulation;
      • to infringe, in any way whatsoever, our moral rights on the Complete Artwork (including the right of authorship, right of withdrawal, right to the integrity of the Complete Artwork), falsify, misrepresent, or conceal the authorship of the Complete Artwork, and in a particular use or exploit Complete Artwork, in any way whatsoever, without crediting us.
    • We reserve all rights in and to the Complete Artwork not expressly granted to you in these Terms. Also, we reserve rights to display, perform and reproduce the Complete Artwork on any media, whether now known or later discovered, for any purpose related to our business, maintenance of our business and promotion of our business, including without limitation the following: (i) display or perform the Complete Artwork on the Website, third-party platforms, social media posts, blogs, editorials, advertising, market reports; (ii) indexing the Complete Artwork in electronic databases, indexes and catalogues; and (iii) hosting, storing, distributing, and reproducing one or more copies of the Complete Artwork within a centralized storage provider, distributed file keeping system, node cluster, or other databases (for example, IPFS) or causing, directing, or soliciting others to do so.
    • If at any time you sell, trade, donate, give away, transfer, or otherwise dispose of a TR3ASURE NFT for any reason, then the exclusive license in and to the underlying Complete Artwork shall immediately expire without the requirement of notice and be transferred along with a TR3ASURE NFT to its new owner and thus you no longer will benefit from the rights granted by such exclusive license. Any use of the Complete Artwork after such disposal of the TR3ASURE NFT shall be considered an infringing act.
    • We represent and warrant that we did not issue and did not cause any third party to issue any NFT or any other digital asset representing the same Complete Artwork and any interest, title to the same Complete Artwork, as well as we agree not to issue in future any NFT or any other digital asset representing the same Complete Artwork, not to tokenize the same Complete Artwork by other means whether currently known or later discovered.

  • No Future Guarantees. Acknowledgements

    TLDR: When purchasing a TR3ASURE NFT, you are only guaranteed the initial launch of NFTs in exchange for your funds and any future benefits should not be taken into consideration, as the legal landscape surrounding DAOs and future plans is constantly changing and uncertain.

    • TR3ASURE Ltd intends to continue releasing content and developing new features for the benefit of its community members. However, the legal landscape surrounding blockchain firms is constantly changing and this uncertainty can lead to necessary adaptations. In addition, please mind that smart contracts, decentralized protocols, blockchain networks, NFTs and distributed ledgers are new technologies and are still experimental in nature.
    • When you purchase a TR3ASURE NFT, you agree that your purchase only guarantees a TR3ASURE NFT in exchange for your funds. Any future benefits are not to be taken into consideration with your purchase, whether through primary or secondary channels, it is only the piece of digital art that you are receiving. You agree that you are not relying on any future commitments by TR3ASURE Ltd beyond the minting of the TR3ASURE NFTs.
    • You hereby acknowledge and agree that any funds received by us for the sale of TR3ASURE NFTs (“Received Funds”) are our revenue and will be utilized by us at our sole discretion. To avoid any doubt, we will not and shall not be obliged to disclose, publish or anyhow make available any or portion of the information relating to our usage or spending of such Received Funds, or account for such Received Funds. You shall never expect that we would use Received Funds in a way that may impact the price, value or availability of TR3ASURE NFTs or any other digital assets.

  • Not Intended as Investments

    TLDR: TR3ASURE NFTs are intended as a fun collectible and have no inherent monetary value, and their potential future value is uncertain and is subject to market demand.

    • TR3ASURE NFTs are intended as a fun collectible, and not as an investment vehicle. We make no promises or guarantees that these TR3ASURE NFTs will be worth more than what you and the market deem the art to be worth. However hard we work to build a community and bring as much energy into the project as possible, your TR3ASURE NFT may be of no inherent monetary value.
    • You hereby acknowledge and agree that TR3ASURE NFTs do not and shall not be construed to grant you any kind of the right to convert such TR3ASURE NFTs into shares of TR3ASURE Ltd or any of its affiliates, does not involve the purchase of shares or any equivalent in any existing or future public or private company, corporation or other entity in any jurisdiction. You hereby acknowledge and agree that the purchase and/or ownership of TR3ASURE NFTs is not meant to generate any profit, interest, gain, dividend nor even to maintain the substance of your contribution, but only allows you to benefit from the functionality of a TR3ASURE NFTs and its underlying Complete Artwork.
    • You hereby acknowledge and agree that we have no debt towards you with respect to TR3ASURE NFTs and will have no obligation to buy back any TR3ASURE NFT from you. A TR3ASURE NFT is not and will never represent a loan to us or any of our affiliates.

  • Taxes

    You are solely responsible for any taxes that may result from minting or reselling your TR3ASURE NFTs.

  • Children

    The TR3ASURE NFT Project is not intended for children, by using the Website and purchasing or intending to purchase a TR3ASURE NFT you confirm that you are at least 18 years old or older than the legal age in your jurisdiction, whichever is greater.

  • Sale of TR3ASURE NFT

    TLDR: When you buy a TR3ASURE NFT, you are making a binding offer to buy it and agree to pay any fees associated with the transaction and allow TR3ASURE Ltd to charge those fees to your payment method or blockchain wallet, and understand that TR3ASURE Ltd is entitled to receive 7% of every time the NFT is sold again and that refunds are not allowed except in cases where the law requires it for statutory warranties or guarantees that cannot be restricted or limited.

    • By initiating issuing (minting) of a TR3ASURE NFT you irrevocably agree to be bound by any outcome of smart contract operations for such issuance (minting). The purchase of a TR3ASURE NFT is final, the payment of the purchase price of a TR3ASURE NFTs is non-refundable except in cases where the law requires it for statutory warranties or guarantees that cannot be restricted or limited.
    • We set the purchase price for TR3ASURE NFTs at our sole discretion and we may change such purchase price at any time without notifying you. You will be required to pay the purchase price before the execution of the smart contract issuing (minting) the TR3ASURE NFT.
    • When you buy a TR3ASURE NFT, you agree to pay any fees associated with the transaction. The main blockchain network supported by the Website is the Ethereum blockchain. The Ethereum blockchain may require you to pay a fee, commonly known as the Ethereum gas fee, for the computational resources required to perform a transaction on the Ethereum blockchain such as issuing (minting) the NFT. We are not and will never be responsible for commissions of any blockchains, ledgers or networks or any third parties even supported by the Website. You acknowledge and agree that we have no control over: (i) any transactions via blockchains, including the Ethereum blockchain; (ii) the method of payment of Ethereum gas fee or similar fees; or (iii) any of your actual payments of Ethereum gas fees or similar fees. Accordingly, while interacting with the Ethereum blockchain you shall ensure that you have a sufficient balance of Ether (native core token of the Ethereum blockchain) kept in your blockchain wallet to complete any transaction on the Ethereum blockchain.
    • You understand and agree that TR3ASURE Ltd is entitled to receive 7% of the purchase price of any secondary market sale of every TR3ASURE NFT (also known as royalty), including sales made through any third-party platform or protocol. TR3ASURE Ltd has the right to receive this royalty fee forever and our smart contracts are designed to withhold such royalty fee from each sale/purchase transaction with a TR3ASURE NFT on a secondary market.
    • Our purchase price and royalty fee include applicable sales, use, value-added, excise, withholding or similar taxes

  • Physical Products Policy

    TLDR: We may occasionally offer Physical Products for sale or for free, with terms and conditions at our discretion, and we do not provide any guarantees or warranties for them.

    Occasionally, we may offer physical products for sale or for free. The terms and conditions for these releases will be at our discretion and by participating, you agree to any applicable terms. We do not provide any guarantees or warranties for physical products. However, if there are any defects or issues with such physical products, we will determine on a case-by-case basis if we will offer any remedial measures. Unless otherwise stated, you will not be able to return or exchange any physical products that you purchase.

    We are not liable for any failure to deliver or any delays in delivery, and we are not liable for any damages or defects caused by any event beyond our control, such as strikes, network breakdowns, floods, fires, explosions, or accidents.

  • Benefits

    TLDR: Owning a TR3ASURE NFT may give you access to special rewards, experiences, or opportunities called "Perks", but please note that TR3ASURE Ltd does not guarantee any Perks and reserves the right to restrict or deny them at any time, and they are not an endorsement of any project, creator, NFT, individual or anything.

    As the owner of a TR3ASURE NFT, you may be eligible for special rewards, experiences, or opportunities as determined by TR3ASURE Ltd at its sole discretion. These rewards are called “Perks”. Please note that TR3ASURE Ltd does not guarantee that you will receive any Perks or achieve any specific outcome as a result of owning a TR3ASURE NFT. TR3ASURE Ltd also reserves the right to restrict, limit, or deny any Perks to any owner of a TR3ASURE NFT, including limiting the time when a Perk is available, for failure to comply with these Terms. Perks are not an endorsement of any project, creator, NFT, individual or anything else. TR3ASURE Ltd. does not provide any investment advice or recommendations in connection with Perks or in relation to owning a TR3ASURE NFT.

  • Liability. Assumption Of Risk. Warranties.

    TLDR: By using the Website and/or purchasing a TR3ASURE NFT, you accept that it may not always be available, of good quality, secure, or accurate, and that it may contain errors or viruses, and you take full responsibility for any issues or risks that may arise from using the Website and/or purchasing a TR3ASURE NFT, TR3ASURE Ltd. is not liable for any issues or damages related to blockchain, blockchain wallets, or NFTs, and you give up the right to file any claims regarding these issues and the company's liability is limited to the amount paid for TR3ASURE NFTs.

    • Except for the express warranties set forth in these terms, TR3ASURE Ltd. hereby disclaims all express or implied warranties with regard to the Website, TR3ASURE NFTs, Complete Artworks or smart contracts, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and quality. TR3ASURE Ltd. makes no representations or warranties regarding the reliability, availability, timeliness, suitability, accuracy or completeness of the Website, TR3ASURE NFTs or smart contracts. Without limiting the generality of the foregoing, TR3ASURE Ltd does not represent or warrant that: (i) the operation or use of the Website or smart contracts will be timely, uninterrupted or error- free; or (ii) the quality of the Website, TR3ASURE NFTs, Complete Artworks or smart contracts will meet your requirements. Except where expressly provided otherwise by us, the Website and smart contracts are provided to you on an “as is” and “as available” basis, Complete Artworks are provided to you on an “as is” and “as generated” basis.
    • TR3ASURE Ltd is not liable for any damages, including direct, indirect, incidental, consequential, punitive, or any other type of damages, arising out of or in connection with the use of TR3ASURE NFTs, including but not limited to the loss of use, data, or profits, or any damages resulting from services provided by TR3ASURE Ltd, or the use of its digital or physical products. Further, TR3ASURE Ltd will not be responsible for any compensation or damages arising in connection with: (i) inaccessibility of Complete Artworks due to any failures of any centralized storage provider, distributed file-keeping system, node cluster, other databases or any third parties; (ii) any unanticipated or unscheduled downtime of all or a portion of the Website or any third parties, facilities or ecosystems hosting or storing Complete Artworks for any reason, including as a result of power outages, system failures or other interruptions; or (iii) any unauthorized access to, alteration of, or the deletion, destruction, damage, loss or failure to store any data.
    • You understand and accept the risks associated with blockchain-based assets, including price volatility, the possibility of losing your assets due to technical issues, and the lack of resell options. TR3ASURE Ltd is not responsible for any risks that arise from the purchase or sale of TR3ASURE NFTs. You are responsible for understanding the risks and we do not provide advice or recommendations.
    • TR3ASURE Ltd does not make any guarantees about the availability of blockchain assets, upgrades to the website, or third-party interactions or their services. The Website may contain links that allow you to access third-party websites or other resources. We provide access only as a convenience and are not responsible for the content, products or services on or available from those resources or links displayed on such websites. When using blockchain technology, blockchain wallets, and NFT marketplaces, there are risks such as hacking, fraud, and cyberattacks. Transactions using blockchain assets are irreversible and any losses may not be recoverable. TR3ASURE Ltd cannot guarantee that the blockchain technology or NFTs will be reliable, error-free, or meet your requirements. We are not responsible for any communication failures, disruptions, errors, or delays related to blockchain assets.
    • TR3ASURE Ltd does not represent and warrant that any smart contracts or blockchains would operate as expected, that execution of any transaction and/or operation would be uninterrupted, accurate, and timely.

  • Indemnification

    TLDR: You will be fully responsible for any legal or financial issues that may arise from your use or misuse of the Website, its content, TR3ASURE NFTs or Complete Artworks or TR3ASURE Ltd's products and agree to cover any costs incurred by TR3ASURE Ltd, its affiliates, and representatives.

    You agree to indemnify and hold harmless TR3ASURE Ltd, its affiliates, and its/their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) and other expenses that arise directly or indirectly from: (i) your use of the Website, TR3ASURE NFTs, Complete Artworks; (ii) your violation of any term of these Terms, including without limitation any actual or alleged breach of your representations, warranties, or obligations set forth in these Terms; (iii) your violation of any third-party right, including without limitation any right of privacy, publicity rights or intellectual property rights; (iv) your violation of any applicable law, rule or regulation; (v) your negligent or willful misconduct; or (vi) any other party's access under your connected wallet and/or use of other appropriate security code. The foregoing shall include the actions of any third party who wrongfully commit these actions under your connected wallet. This indemnification obligation includes any claims or actions brought by any third party alleging that your use of a TR3ASURE NFT infringes or violates their rights.

  • Feedback

    TLDR: By submitting any feedback, you grant us a perpetual, irrevocable, non-exclusive, worldwide license to use it for any purpose without additional compensation.

    By providing us with feedback, such as comments, bug reports, or suggestions for improvements on the Website, by email or by any other means of communication you grant us the unrestricted right to utilize that feedback in any way we see fit, without any further compensation owed to you. Furthermore, you are conferring upon us a long-term, unconditional, non-exclusive, worldwide license to employ the feedback for any purpose.

  • Updates to the Terms

    TLDR: We can change the terms at any time and it is your responsibility to regularly check for updates, continued use of the site after changes implies acceptance of the updated terms, if you do not agree with the changes, you should stop using the Website.

    We retain the right to alter the Terms at our discretion, without prior notice to you. It is your obligation to review these Terms periodically to stay informed of any changes. Any revisions to these Terms will become effective immediately upon implementation. Your continued use of the Website after such modifications implies your acceptance of the updated Terms.

  • Governing Law. Dispute Resolution

    TLDR: By agreeing to these Terms, both parties agree to resolve disputes and claims through the British Virgin Islands International Arbitration Centre under the laws of the British Virgin Islands, waiving any rights to initiate legal proceedings or appear in court, and waiving the right to a trial by jury, with the exception of seeking court injunctions for alleged intellectual property infringement, and that either party may seek temporary or emergency equitable relief in any court of competent jurisdiction.

    • These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands excluding its conflicts of law rules and principles.
    • Any dispute controversy, or claim arising out of, or relating to, or in connection with these Terms, including with respect to the formation, applicability, breach, termination, invalidity, enforceability or any dispute regarding non-contractual obligations arising out of or relating to such obligations, shall be referred to the British Virgin Islands International Arbitration Centre for resolution pursuant to the BVI IAC Arbitration Rules (in force at the time of submission of a Notice of Arbitration and as may be amended from time to time). The number of arbitrators shall be one. The language to be used in the arbitral proceedings shall be English.
    • By accepting these Terms, you agree to waive any and all rights to initiate legal proceedings or to appear in court to assert or defend any rights under these terms and conditions. Any claims or disputes arising under these terms and conditions shall be resolved through individual arbitration and not as a class, collective, or representative action. You and TR3ASURE Ltd. also waive your respective rights to a trial by jury in the event that any claim or dispute proceeds in court.

  • General Terms

    TLDR: You cannot transfer your rights to anyone else, we may transfer our rights. These Terms will remain effective even if not strictly enforced. All formal notices under these Terms shall be in English. If any provision of these Terms be held invalid, the remaining provisions will remain in full force and effect.

    • These Terms of NFT Sale and Use, the Privacy Policy, and all other documents incorporated by reference herein and therein, comprise the entire agreement between you and us.
    • Section headings in these Terms are for convenience only, and shall not govern the meaning or interpretation of any provision of these Terms.
    • These Terms are personal to you, you cannot transfer or assign your rights, licenses, interests and/or obligations to anyone else. We may transfer or assign our rights, licenses, interests and/or our obligations at any time, including as part of a merger, acquisition or other corporate reorganization involving TR3ASURE Ltd.
    • Nothing in these Terms shall be deemed or is intended to be deemed, nor shall it cause, you and us to be treated as partners, joint venturers, or otherwise as joint associates for profit, or either you or us to be treated as the agent of the other.
    • Should any part of these Terms be held invalid or unenforceable, that portion shall be construed as inconsistent with applicable law and the remaining portions will remain in full force and effect.
    • We may not always strictly enforce our rights under these Terms. If we do this, it will be just a temporary measure and we may enforce our rights strictly again at any time. Our failure to enforce any provision of these Terms will not be deemed a waiver of such provision, nor of the right to enforce such provision.
    • These Terms and any information or notifications that you or we are to provide should be in English. Any translation of these Terms or other documents is provided for your convenience only. In the event of any inconsistency, the English language version of these Terms or other documents shall prevail.
